Process
Mediation is aimed at anyone experiencing a family dispute or disagreement, whether personal or property-related: separation of a married or unmarried couple, inheritance disputes, division of movable and/or immovable property, exercise of parental authority, maintenance contributions, family tensions, etc.
Mediation involves the parties concerned working together on a voluntary basis to find a solution to a dispute. The process is confidential and supervised by a mediator who acts as an impartial third party. Over the course of several sessions, the aim will be to :
- define the purpose of the mediation,
- analyse the facts,
- identify each person's priorities,
- to finally discuss possible solutions with a view to reaching an agreement.
Documents following the mediation agreement
The mediation agreement may then be the subject of either an authenticated deed or judicial homologation, which will give the agreement the force of a judgement.
Once the parties have reached an agreement during mediation, it can be formalised in an authenticated deed. This is signed by the parties and is enforceable, guaranteeing implementation of the agreement.
If the parties prefer, or if the law requires, the mediation agreement can be submitted for judicial homologation, where a judge examines the agreement and transforms it into an enforceable judicial decision. This homologation gives the agreement the same force as a court judgement, ensuring its validity and binding enforcement.
